TERMS AND CONDITIONS OF THE GOLDENDREAMS.COM.PL ONLINE STORE

These terms and conditions define the rules for using the online store goldendreams.com.pl and the rules for concluding distance sales agreements.

1. GENERAL PROVISIONS

1.1. The online store available at the website [www.goldendreams.com.pl](http://www.goldendreams.com.pl) is operated by INWEST-INOX SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, registered in the Central Registration and Information on Business of the Republic of Poland, maintained by the minister responsible for the economy, with the business address and correspondence address at ul. Tarnowska 169, 33-300 Nowy Sącz, Tax Identification Number (NIP): 7343629126, and email address: [kontakt@goldendreams.com.pl](mailto:kontakt@goldendreams.com.pl).

1.2. These Terms and Conditions are addressed both to consumers and to entrepreneurs using the Online Store.

1.3. The administrator of personal data processed in the Online Store in connection with the implementation of the provisions of these Terms and Conditions is the Seller.

1.4. The Terms and Conditions define the rules for using the Online Store as well as the terms and procedures for concluding Sales Agreements with the Customer through the Online Store.

1.5. By starting to use the Online Store, each Customer agrees to comply with the provisions of these Terms and Conditions.

1.6. In matters not regulated by these Terms and Conditions, the following provisions shall apply:

  • The Act of April 23, 1964, Civil Code
  • The Act of May 30, 2014, on Consumer Rights
  • The Act of July 18, 2002, on the Provision of Electronic Services
  • The Act of March 2, 2000, on the Protection of Certain Consumer Rights and Liability for Damage Caused by a Dangerous Product

2. ELECTRONIC SERVICES IN THE ONLINE STORE

2.1. The following Electronic Services are available in the Online Store:

  • Blog – enabling browsing of articles and posts related to products and advice
  • Account – enabling management of personal data, order history, and shopping preferences
  • Contact Form – enabling communication with the Seller
  • Order Form – enabling placing orders in the Online Store
  • Newsletter – enabling receiving information about new products and promotions

2.2. Technical requirements necessary to work with the IT system used by the Online Store:

  • An end device with Internet access
  • A web browser that supports JavaScript
  • An active email account
  • Enabled cookie support

2.3. The service recipient agrees to use the Online Store in a manner consistent with the law and good practices, respecting the personal rights of third parties and intellectual property rights.

3. TERMS OF CONCLUDING A SALES AGREEMENT

3.1. The conclusion of a Sales Agreement between the Customer and the Seller takes place after the Customer has submitted an Order using the Order Form in the Online Store.

3.2. The Product price shown on the Online Store website is the gross price and includes VAT.

3.3. The Customer places an Order by:

  • Adding the selected Product to the shopping cart
  • Selecting the "Proceed to checkout" option
  • Filling out the Order Form
  • Selecting the payment and delivery method
  • Clicking the "Order and Pay" button

3.4. After placing the Order, the Seller promptly confirms its receipt and simultaneously accepts the Order for processing. Confirmation of receipt and acceptance of the Order is made by sending the Customer an appropriate email to the email address provided during the Order placement.

4. METHODS AND DEADLINES FOR PAYMENT FOR THE PRODUCT

4.1. The Seller provides the Customer with the following payment methods:

  • Cash on delivery – payment upon receipt of the shipment
  • Electronic payments and payment card – via online payment systems
  • Deferred payment system – available for regular customers

4.2. Payment deadline:

  • In the case of choosing electronic payments or payment by card, payment is made before the Product is shipped.
  • In the case of cash on delivery, payment is made upon receipt of the shipment.
  • In the case of deferred payments, payment is made according to individual arrangements.

4.3. The Seller undertakes to issue proof of sale (VAT invoice) at the Customer's request.

5. METHODS AND DELIVERY TIME FOR THE PRODUCT

5.1. Delivery of the Product to the Customer is subject to a fee, except for exceptions specified in the Terms and Conditions.

5.2. The Seller provides the Customer with the following delivery methods:

  • Postal shipment – standard delivery via the Polish Post Office
  • Courier shipment – express delivery via a courier company
  • Cash on delivery courier shipment – courier delivery with payment upon receipt

5.3. Order fulfillment time:

  • The standard order fulfillment time is up to 3 business days.
  • For made-to-order products – up to 14 business days.
  • For custom orders – upon individual agreement.

6. COMPLAINTS PROCEDURE

6.1. A complaint may be submitted by the Customer:

  • in writing to the address: ul. Tarnowska 169, 33-300 Nowy Sącz

6.2. The complaint should include:

  • Customer details of the person submitting the complaint
  • Order number
  • Description of the situation
  • Customer’s request

6.3. The Seller shall review the complaint within 14 days of its receipt.

6.4. The response to the complaint will be sent to the Customer electronically or by post, according to the Customer’s preferences.

7. OUT-OF-COURT METHODS OF HANDLING COMPLAINTS

7.1. The Customer has the option to use out-of-court methods for handling complaints and pursuing claims.

7.2. The Customer may make use of the following institutions:

  • Permanent Consumer Arbitration Court
  • Voivodeship Inspectorate of Trade Inspection
  • European Consumer Centre

7.3. The Customer may also use the ODR (Online Dispute Resolution) platform available at: [http://ec.europa.eu/consumers/odr/](http://ec.europa.eu/consumers/odr/)

8. RIGHT OF WITHDRAWAL FROM THE CONTRACT

8.1. The Consumer has the right to withdraw from the contract within 14 days without giving any reason.

8.2. The deadline for withdrawing from the contract expires 14 days after the day on which the consumer or a third party designated by them, other than the carrier, took possession of the product.

8.3. In the case of a contract covering multiple products that are delivered separately, in batches, or in parts, the deadline expires 14 days after the day the consumer took possession of the last product.

8.4. In the case of a contract where the product is delivered regularly over a specified period of time, the deadline expires 14 days after the day the consumer took possession of the first product.

9. PROVISIONS REGARDING ENTREPRENEURS

9.1. This section of the Terms and Conditions and the provisions contained therein apply solely to Customers and Service Recipients who are not consumers.

9.2. The Seller reserves the right to withdraw from the concluded Sales Agreement within 14 calendar days from the date of its conclusion.

9.3. In the case of entrepreneurs, the Seller is not liable for any damages arising in connection with the activity conducted by the Customer.

9.4. In the case of entrepreneurs, the Seller reserves the right to charge statutory interest in the event of a delay in payment.

10. PRODUCT REVIEWS

10.1. The Seller allows Customers to leave reviews about Products under the terms set forth in the Terms and Conditions.

10.2. Reviews can only be published by Customers who have purchased the respective Product.

10.3. Reviews must not contain:

  • Content that is illegal.
  • Content that infringes on the personal rights of third parties.
  • Advertising content.
  • Offensive or vulgar content.

10.4. The Seller reserves the right to remove reviews that violate the above-mentioned rules.

11. ILLEGAL CONTENT

11.1. The Service Recipient is obliged to comply with the rules set forth in the Terms and Conditions regarding the content posted in the Online Store.

11.2. It is prohibited to post the following content in the Online Store:

  • Illegal content.
  • Content that infringes the rights of third parties.
  • Offensive or vulgar content.
  • Advertising content without the Seller's consent.

11.3. The Seller reserves the right to remove content that violates the above-mentioned rules.

12. FINAL PROVISIONS

12.1. Contracts concluded through the Online Store are made in Polish.

12.2. The Seller reserves the right to change the Terms and Conditions at any time.

12.3. Changes to the Terms and Conditions take effect as soon as they are published on the Online Store's website.

12.4. In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply.

12.5. Any disputes arising from contracts concluded through the Online Store will be resolved by the court competent for the Seller's registered office.

13. SAMPLE WITHDRAWAL FORM

13.1. The sample withdrawal form is available in Annex No. 2 to the Consumer Rights Act.

13.2. The withdrawal form can be downloaded from the Online Store's website or obtained in paper form upon the Customer's request.

13.3. The completed form should be sent to the Seller's address or electronically.
